Content Provider Agreement

This Content Provider Agreement ("Agreement") is binding on all users who upload photos, videos, or other content to the platform. By electronically confirming this Agreement, the user declares that they understand and agree to all of the terms set out below.

This Agreement is separate and independent from the general website terms of use and privacy policy.

1. General Provisions

1.1. The user undertakes to comply with all applicable laws of the European Union, the Republic of Lithuania and other applicable legislation, as well as platform rules.
1.2. Only lawful, voluntarily created content that meets the requirements of this Agreement may be uploaded to the platform.
1.3. The platform reserves the right at its sole discretion to review, moderate, restrict, or remove any content that may violate laws, payment card operator rules, platform policy, or pose reputational or legal risks.

2. User Representations and Warranties

By uploading content, the user irrevocably confirms and warrants that:
2.1. All uploaded content has been created voluntarily and with the explicit consent of all persons visible in it.
2.2. The content is not associated with:
- coercion;
- exploitation;
- human trafficking;
- minors;
- non-consensual sexual conduct;
- threats or blackmail;
- depiction of intoxicated persons or persons incapable of giving consent;
- any other unlawful activity.
2.3. All persons depicted in the content are at least 18 years of age at the time of upload.
2.4. The user holds valid and sufficient evidence confirming the age and identity of all persons and their voluntary consent to participate in the content.
2.5. The user holds all copyright, related rights and other necessary permissions to publish the content on the platform.
2.6. The content does not infringe any third-party rights, including privacy rights, copyright, trademarks, publicity rights and personal data protection requirements.
2.7. The content complies with the Visa Adult Content Merchant Registration Program, Mastercard Adult Content Merchant Compliance Program, EU legislation, and applicable e-commerce, consumer protection and data protection requirements.

3. Prohibited Content

It is strictly prohibited to publish or distribute on the platform:
- content depicting minors or persons under 18 years of age;
- artificially generated or manipulated content that may depict minors;
- non-consensual or coercive sexual content;
- 'revenge porn' or content published without consent;
- sexual violence or exploitation;
- extreme violence;
- zoophilia;
- incest;
- content bearing signs of human trafficking;
- content that violates human dignity or laws;
- content prohibited under Visa or Mastercard rules.
Any such content will be immediately removed, and the platform has the right to pass information to competent authorities.

4. Age and Identity Verification

4.1. The platform reserves the right at any time to request additional information or documents to verify the user's identity and age, the age of persons in the content, consent to participate, and copyright in the content.
4.2. Such documents may include a copy of a passport or identity card, a photo of the person with the document, a model consent form, and additional information about how the content was created.
4.3. If the requested documents are not submitted within the platform's specified deadline, the content may be removed, the account restricted or suspended, payments withheld, and the account permanently blocked.
4.4. The platform reserves the right to refuse publication or remove content if there are reasonable doubts regarding age, consent, legality, authenticity or rights to the content.

5. Record and Document Retention

5.1. The user undertakes to retain all age, identity and consent evidence for at least 5 years from the date of content removal, or longer if required by law.
5.2. The platform may retain submitted documents for as long as necessary for fulfilling legal obligations, fraud prevention, payment partner requirements, dispute resolution and protection of legitimate interests.

6. Cooperation with Investigations and Audits

6.1. The user agrees to cooperate with the platform in compliance checks, payment partner audits, law enforcement requests, and investigations of fraud or unlawful activity.
6.2. The platform reserves the right to pass information to competent authorities, payment operators, Visa, Mastercard or other partners, where required by law or compliance procedures.

7. Liability and Sanctions

7.1. The user bears full responsibility for the content they have uploaded.
7.2. In the event of a breach of this Agreement, the platform may remove the content, restrict account functionality, suspend or terminate the account, withhold payments, notify law enforcement authorities, and take legal action for damages.
7.3. The platform bears no liability for content uploaded by users but reserves the right to carry out active moderation and preventive measures.

8. Electronic Consent

By confirming this Agreement and using the content upload feature, the user:
- confirms that they have read this Agreement;
- understands its content;
- agrees to all of its terms;
- provides a legally binding electronic consent.
